In the year of our Lord 1741 November ye 2nd
The last- Will of Caspar Jakkels made by him When he was yet in his perfect senses; and whereby he has ordered and confirmed how it should be kept after his Decease with his whole estate Real and Personal; and what parts thereof should be assigned for ye Mother and Child; thus drawn up and signed by Witnesses for an unchangeable validity.
Art. I. All Moveables and Immoveables shall be summed up and reckoned together and all Debts be first payed out of it.
2. In case of ye Mother should re-marry everything as well Money as Goods shall be summed up and appraised whereof ye Child is to have one third Part.
3. If it should happen that ye Child died and if Mother inherit its Part, it has been agreed to by him that in this case if Ye Mother was to marry again after ye Childs Death, then one half of ye Child’s Part is to fall to ye Child's Father’s Brothers and Sisters; But to excite a mutual and good Confidence Between ye Mother and ye Father's Brothers and Sisters; Ye following Condition has been reserved according to his Will, Viz; That if after her Re-marrying evident Misfortune should befall ye Mother such as Poverty or Inability to provide for her subsistance, then she shall not be obliged to return ye above mentioned Half to ye Father’s Brothers and Sisters, tho this has been considerately left to ye Discretion of ye Parties to act jointly in ye Case.
4, In ye respect to ye third Article, it has been found good to mention here for ye preventing of Disputes that it has been agreed upon that no Pretence to ye Child’s Portion shall find Place, till ye eighteen Years be expired during which ye child is to be educated and provided for by ye Mother and that if claim of ye afore third Article takes Place after ye Child’s Death.
5. But in Case it should come to pass that either ye Child and its Part came to ye Mother and consequently ye Mother should die Widow; then what remains comes to ye Relations of both sides to be equally shared between them; and if the Mother should die Widow before ye Child then all is left to ye Child; ye Child afterwards also dying ye rest comes to ye Relations on both sides and so be equally shared as above.
All this has been uttered and publickly mentioned by him in the Presence of ye here subscribed Witnesses and for ye more Confirmation of it he has signed it with his own hand. his Caspar CI Jakkel
